Disciplinary Committee

In accordance with article 14.7 of the Staff Regulations and following approval by the Governing Body, the Director-General amended Chapter XII (Discipline) and related provisions of the Staff Regulations. These amendments have been adopted further to recommendations from the ILO Committee on Accountability and the Joint Advisory Appeals Board and in accordance with recent comments of the ILO Administrative Tribunal concerning the need to implement a progressive disciplinary policy.

The amendments became effective as of the date of the Governing Body’s approval, i.e. 31 October 2023. They were published in the Office Directive IGDS n°663 (version 1). These amendments will be integrated in the electronic version of the Staff Regulations available on the ILO website in due course.

One of the main amendments of Chapter XII of the Staff Regulations is the establishment of an advisory body, the Disciplinary Committee, which will assist the Director-General during disciplinary proceedings. Pursuant to Article 12.2.5 of the Staff Regulations, The Disciplinary Committee shall:

  1. assess whether misconduct has occurred, having regard to all the available documentation;
  2. if it is satisfied that misconduct has occurred, determine its seriousness, in light of any aggravating or mitigating circumstances; and
  3. deliver a reasoned opinion to the Director-General in the form of a report, setting out the Disciplinary Committee’s recommendation as to any proposed disciplinary measure or measures that should be applied to the official concerned.

Members of the Disciplinary Committee

The Director-General nominated, as of 15 November 2023, the following officials as members of the Disciplinary Committee:

  • Ms. Panudda BOONPALA, Deputy Regional Director of the Regional Office for Asia and the Pacific;
  • Ms. Karen CURTIS, Chief of the Freedom of Association Branch of the International Labour Standards Department;
  • Mr. Martin MURPHY, Director of the Department of Communication and Public Information;
  • Mr. Alexio MUSINDO, Director of the Country Office for Ethiopia, Djibouti, Somalia, Sudan and South Sudan, and for the Special Representative to the AU and the ECA.

The Director-General nominated, as of 15 November 2023, the following officials as substitute members of the Disciplinary Committee:
 

  • Ms Sukti DASGUPTA, Director of the Conditions of Work and Equality Department;
  • Mr. Emmanuel Julien, Deputy Regional Director of the Regional Office for Europe and Central Asia;
  • Mr Ritash SARNA, Deputy Director of the Department of Statistics;
  • Ms. Dagmar Walter, Senior Adviser of the Research Department.

The members of the Disciplinary Committee as well as their substitutes were nominated for a term of office aligned with that that of the Director-General, i.e., until 30 September 2027, unless their appointment ends before that date.
 

Chairperson and Rules of procedure

During its first meeting held on 7 December 2023, the Disciplinary Committee elected Ms. Karen CURTIS as its Chairperson and adopted its Rules of procedure, pursuant to paragraph 2 of Article 12.2 of the Staff Regulations.
 

Secretary of the Committee

The Director-General designated M. François Molas, Human Resources Officer within the Human Resources Development Department to serve as secretary of the Disciplinary Committee, as of 15 November 2023 until 30 September 2027, unless his appointment ends before that date.
